Gameday Contests Terms and Conditions

Last updated: September 24, 2026

These Terms and Conditions (“Terms”) govern access to and use of the Gameday Contests website, applications, software, content, tools, and related services (collectively, the “Platform”). By accessing or using the Platform, creating an account, joining a contest, creating a contest, or otherwise using any Platform feature, each user agrees to be bound by these Terms.

1. About the Platform

Gameday Contests is a software-as-a-service platform that enables users, hosts, organizations, leagues, and communities to create, manage, and participate in sports prediction contests and related game experiences. The Platform is intended for entertainment, community engagement, and skill-based competition.

The Platform is not a sportsbook, bookmaker, casino, gambling operator, money transmitter, payment processor, escrow provider, or financial institution. The Platform does not offer or facilitate wagering, betting, pooled stakes, or gambling activity through the Platform.

2. Eligibility

Use of the Platform is permitted only by persons who are legally permitted to use the Platform under applicable law. Users are responsible for ensuring that their access to and use of the Platform is lawful in their jurisdiction.

By using the Platform, each user represents and warrants that:

The Platform may suspend, restrict, or terminate access where eligibility, legality, or compliance concerns arise.

3. Accounts

Certain Platform features require account registration. Users are responsible for maintaining the confidentiality of their login credentials and for all activity occurring under their accounts.

Users may not share accounts, impersonate another person, create accounts using false information, or attempt to access accounts, data, or systems without authorization. The Platform may require verification steps, disable accounts, or reclaim usernames at its discretion.

4. SaaS Fees and Platform Access

The Platform may charge hosts, organizations, administrators, or users fees for access to software features, hosting, contest-management tools, premium functionality, analytics, customization, administration, support, or related services.

All amounts paid to the Platform are fees for access to software and related services only. No fee paid to the Platform constitutes a wager, stake, bet, pooled contribution, prize-pool contribution, deposit for gambling purposes, or consideration paid to participate in a gambling activity.

Unless expressly stated otherwise in a separate written agreement, all fees are non-refundable except where required by law. Billing terms, renewals, plan limits, feature availability, and usage restrictions may be described on the applicable pricing page, order form, subscription workflow, or service agreement.

5. No Gambling or Wagering

The Platform does not accept, hold, transmit, pool, settle, or pay out money or anything of value based on the outcome of a sporting event or contest performance. The Platform does not facilitate real-money betting, peer-to-peer wagers, side bets, pooled entry fees for prize distribution, or sportsbook operations.

The display of scoring mechanics, game data, market-style information, or prediction multipliers is for game functionality and contest scoring only. Such functionality does not create a wagering relationship between the Platform and any user.

6. Virtual Shares and Contest Points

The Platform may use virtual units such as shares, points, credits, scores, badges, rankings, or similar in-platform indicators (collectively, “Virtual Units”). Virtual Units are fictional, non-transferable, limited-use game metrics used solely for contest scoring, progression, display, or ranking purposes within the Platform.

Virtual Units:

Any references to allocations, balances, gains, returns, standings, or results relating to Virtual Units are part of the Platform’s game logic only and do not reflect real-money value or entitlement.

7. Contests and Hosts

The Platform may allow certain users or organizations (“Hosts”) to create public or private contests, establish contest settings, select contest schedules or slates, invite participants, and administer contest features made available by the Platform.

Hosts are responsible for configuring contests in compliance with these Terms and applicable law. Hosts may not use the Platform to create or administer contests that involve illegal wagering, unlawful prize promotions, unauthorized sweepstakes, raffles, lotteries, or any activity that would cause the Platform or its users to violate applicable law.

The Platform may impose limits on contest formats, participant eligibility, visibility, scoring options, start times, end times, administrative controls, and other operational settings.

8. Contest Rules and Scoring

Each contest may be subject to published rules, settings, tiebreakers, scoring logic, deadlines, data dependencies, and operational constraints established by the Platform, the Host, or both. By joining a contest, each participant agrees to the applicable contest rules.

The Platform may use sports schedules, game status feeds, odds-style inputs, or other third-party sports data as part of contest functionality and scoring logic. The Platform may lock selections at scheduled game start times, when a game is reported live, or at any other integrity checkpoint defined by the Platform.

The Platform may correct obvious errors, grading mistakes, data-feed anomalies, duplicate entries, delayed updates, or system malfunctions. All Platform determinations regarding contest integrity, timing, data reconciliation, scoring corrections, voided picks, and final standings are final, except where the Platform elects to review a matter.

9. No Cash Prizes Through the Platform

Unless the Platform expressly states otherwise in a separate written promotion or agreement, contests on the Platform are for entertainment, rankings, recognition, and non-cash game outcomes only.

The Platform does not provide, custody, escrow, or distribute cash prizes, cryptocurrency, gift cards, stored value, redeemable credits, or other items of monetary value based on contest outcomes. Any unauthorized off-platform arrangement made by users or Hosts is outside the Platform and solely the responsibility of those parties.

10. Prohibited Conduct

Users may not:

The Platform may investigate suspected violations and may suspend or terminate access, remove content, cancel contests, void activity, or take other action deemed appropriate.

11. Subscriptions, Billing, and Changes

Subscription plans, feature tiers, limits, and pricing may change from time to time. The Platform may add, remove, suspend, or modify features, functionality, contest formats, support levels, or integrations at any time.

Where recurring billing applies, subscriptions may renew automatically unless canceled in accordance with the applicable billing terms. Users and Hosts are responsible for keeping payment and billing information current.

Failure to pay applicable fees may result in suspension, downgrade, restricted access, or termination of the relevant account, subscription, workspace, or contest-management functionality.

12. Intellectual Property

The Platform and its software, interfaces, branding, design, content, data compilations, features, and functionality are owned by the Platform or its licensors and are protected by applicable intellectual property laws.

Subject to these Terms, the Platform grants a limited, non-exclusive, non-transferable, revocable right to access and use the Platform for its intended purpose. No license is granted to copy, modify, distribute, reverse engineer, create derivative works from, or exploit the Platform except as expressly permitted by law or written authorization.

13. User Content

Users may submit names, logos, contest descriptions, messages, images, picks, settings, and other content (“User Content”) through the Platform. Each user retains ownership of User Content they lawfully own, but grants the Platform a non-exclusive, worldwide, royalty-free license to host, reproduce, display, process, and use that User Content as necessary to operate, improve, secure, and provide the Platform.

Users are solely responsible for User Content they submit and represent that they have all rights necessary to submit it. The Platform may remove or restrict User Content that violates these Terms, applicable law, or Platform policies.

14. Third-Party Data and Services

The Platform may rely on third-party providers for sports schedules, scores, game status, odds-style data, hosting, analytics, authentication, communications, billing, and other functionality. The availability, timeliness, and accuracy of certain Platform features may depend on those third parties.

The Platform does not guarantee that third-party data will be complete, current, uninterrupted, or error-free. Delays, corrections, feed outages, and discrepancies may affect contest displays, scoring previews, or settlement logic.

15. Disclaimers

The Platform is provided on an “as is” and “as available” basis to the fullest extent permitted by law. The Platform disclaims all warranties, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, and accuracy.

The Platform does not warrant that the service will be uninterrupted, secure, error-free, or suitable for every intended use case. Use of the Platform is at each user’s own risk.

16. Limitation of Liability

To the fullest extent permitted by law, the Platform and its affiliates, officers, directors, employees, contractors, licensors, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, punitive, or lost-profit damages, or for any loss of data, goodwill, business opportunity, or service availability arising out of or related to the Platform or these Terms.

To the fullest extent permitted by law, the aggregate liability of the Platform for all claims arising out of or relating to the Platform or these Terms will not exceed the greater of (a) the amount paid by the claimant to the Platform in the 12 months preceding the event giving rise to the claim, or (b) $100.

17. Indemnification

Each user and Host agrees to defend, indemnify, and hold harmless the Platform and its affiliates, officers, directors, employees, contractors, licensors, and service providers from and against any claims, demands, actions, liabilities, damages, judgments, settlements, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:

18. Suspension and Termination

The Platform may suspend, restrict, disable, or terminate any account, contest, workspace, subscription, or access to the Platform at any time, with or without notice, where the Platform believes such action is necessary to protect the Platform, users, data integrity, legal compliance, or service operations.

Upon termination, rights granted under these Terms cease immediately, but provisions that by their nature should survive will survive, including provisions regarding fees owed, intellectual property, disclaimers, limitations of liability, indemnification, dispute resolution, and other continuing obligations.

19. Changes to the Terms

The Platform may update these Terms from time to time. Updated Terms become effective when posted, unless a later date is stated. Continued use of the Platform after revised Terms become effective constitutes acceptance of the updated Terms.

If a change materially affects rights or obligations, the Platform may provide additional notice through the service, by email, or by other reasonable means.

20. Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except to the extent superseded by applicable federal law.

Any dispute arising out of or relating to these Terms or the Platform shall be brought exclusively in the state or federal courts located in Williamson County, Texas or the nearest available court with proper jurisdiction, and each party consents to personal jurisdiction and venue in those courts.

21. Severability and Waiver

If any provision of these Terms is held unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in full force and effect.

No waiver of any provision of these Terms will be deemed a further or continuing waiver of that provision or any other provision.

22. Contact

Questions about these Terms may be directed through the contact information provided on the Platform.
